The following are the terms under which Carmistin Group allows the use of this website. If you do not fully agree to them, please cease using the services provided through the website www.carmistin.ro.
SERVICE DESCRIPTION
Carmistin Group manages online applications for available jobs, as well as user questions. Other services to be implemented, in time, on www.carmistin.ro, are subject to the same terms, except for the case when they do not have distinctly formulated use terms. In order to publish/amend/view the ad or to view employment offers available on www.carmistin.ro, you must gain access to World Wide Web (Internet), directly or through other devices that can access Internet services, paying any fee associated to this access. In addition, you must have available all required equipment to make this connection to the World Wide Web, including a computer and a modem or other access equipment.
Definitions
In the sense of these terms, the following words are defined as follows:
- User – any person interested in the provision of the service;
- Service – provision of user access to data and information sent by www.carmistin.ro through the Internet, by means of this website.

User Obligations
The User agrees to use the service only for legal purposes. The User undertakes:
a) not to amend, distribute, send, display, publish, reproduce, grant licenses, create derived products, transfer or sell any information or service obtained from or through this website;
b) not to use and not to allow (or authorize) any third parties to use the service or the website www.carmistin.ro to send or receive materials contrary to the legal provisions in force or have obscene, abusive, vulgar, defamatory, offensive, threatening, xenophobic content, content that breaches any other intellectual property rights or affect the privacy of any other person, content that incites to racial or ethnic hatred or is offensive in any other way;
c) not to perform (or allow the performance of) any cracking or hacking activities (cracking or hacking means the unauthorized bypassing of the user authentication service or other security services of any network, server, web server or user account), or “Denial of Service”-type attacks (“Denial of Service”-type attacks – “Denial of Service” means interference with the Service, referring to any user, network or server, thus blocking the access to/from the Service). The Users that breach systems or networks security shall be brought to court, civilly and criminally.
The User agrees not to hold liable and not to bring Carmistin Group to justice in terms of any claims of third parties, as a result of the User using the service or the website www.carmistin.ro and the Internet, as well as in terms of any (direct, indirect, consequential or other) loss, costs, actions, trials, claims, expenses (including court costs) or other liabilities, suffered as a result of the User breaching or ignoring these terms.
The payment of all additional expenses related to the service use, request of services from associated companies, including the ones the services or Internet provider may request, is the responsibility of the User.
Content
You understand that all information: data, text, software, photographs, graphics, messages or other materials (hereinafter called “CONTENT”), irrespective of whether publicly displayed or individually sent, in private, is the sole responsibility of the person who is the source of these materials. This means that you and not Carmistin Group, are fully liable for all materials you upload or make available through our website. Carmistin S.R.L. is not in control, but merely monitors the send content and therefore does not guarantee the accuracy, integrity and quality of this content. You understand that by using the services provided by www.carmistin.ro, you may be exposed to content that may be offensive or indecent.
You agree, under the sanction of applying the legal provisions in force in Romania, not to use the services made available by Carmistin Group through or in order to:
- falsify the identification information or manipulate them in any other way, for the purpose of disguising or hiding the origin of any content sent through the website or developing hidden pages or images (like the ones with no active link from a page inside that website);
- upload, post, disseminate or send in any way, any content for which you do not have the legal right to transfer or disseminate in any conditions, under any legal system, Romanian or foreign, contractual or trusting relations (such as confidential information, proprietary information, found or disclosed as part of work relations or subject to confidentiality agreements);
- upload, post, disseminate or send in any way, any type of advertising, promotional materials, “junk mail”, “spam”, chain letters, pyramid schemes or any other form of soliciting, except for parts of the service that are formed for this purpose;
- upload, post, disseminate or send in any way, any material containing viruses or any other type of code, files or software created to destroy, interrupt or limit the operation of any other software, hardware or telecommunication equipment.
General Practices on Use and Storage
You are ware that Carmistin Group may constitute a set of general practices and limitations on using the services. Currently, the maximum size of a file that is included in an ad is 100 KB, files larger than 100 KB cannot be transferred to the server, and the accepted file types are only images: exclusively .jpg, .jpeg and .gif extensions.
Termination of Collaboration
You agree that Carmistin Group, if deemed appropriate, may block your use of services and may remove or delete any content from the services, for any reason, or if the Carmistin Group team believes that you have breached or have not acted according to the letter or spirit of the Terms and Conditions. Also, Carmistin Group may, at any time and without motivation, interrupt the provision of services or any part of them, with or without any previous notifications. You agree that any termination of your access to the provided services, according to any rule in the Terms and Conditions, may be made without previous warning.
Advertising
We use the Google AdSense, Google Conversion Tracking and Google Remarketing services on our webpages.
Google Conversion Tracking is an analysis service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”) designed to measure the success of our advertising campaigns activated by Google (AdWords). In this context, Google sets a cookie module on your computer when you access a Google ad and reach our webpage. These cookie modules are valid for 30 days and do not allow personal identification. With the help of Google Conversion Tracking, we and Google can identify that someone clicked our advertisement and was thusly redirected to our webpage. However, we cannot see other internet pages you opened. The data collected with Google Conversion Tracking exclusively serve for preparing statistics on the success and use of our campaigns with AdWords. We do not collect and do not receive any information based on which the user can be identified.
In addition, we use Google AdSense on our webpages, a Google advertising service, to activate commercials (text ads, banners). Thusly, your browser sometimes stores a cookie module sent by Google or third parties. The information stored in the cookie module may be recorded, collected and evaluated by Google or third parties. In addition, Google AdSense uses the so-called web beacons for collecting information and small size transparent graphic images, through which we can record, collect and evaluate simple actions, visitors traffic on the webpage. The information obtained with the cookie module and/or images referring to the use of this page is transferred on a Google server and stored there. Google uses the information thusly obtained to perform an evaluation of your use behaviour in relation to AdSense ads. Possibly, Google transfers this information to third parties, if this is required by law or if such data is processed by third parties for Google. Your IP address is not associated to other data stored by Google.
In addition, we also use remarketing technologies provided by Google on our webpages. Through these technologies, the users who have already visited our webpages can be approached again through targeted advertising on other pages of Google partners’ network. Google’s remarketing technologies also use cookie modules.
If you do not wish to receive interests-based advertising, you can deactivate the use of cookie modules through Google for these purposes accessing this webpage and making the settings that fit you for the purpose of internet ads customization.
If you do not wish to participate in Google AdSense, Google Conversion Tracking or Google Remarketing, you can also refuse the required setting for this purpose of a cookie module – by setting the Internet browser to generally deactivate the automated setting of cookie modules. In addition, you can deactivate cookie modules for Google advertising services by setting your Internet browser so that cookie modules of “googleadservices.com” domain are blocked. In addition, we also use Facebook Conversion Pixel and Facebook Remarketing services on our webpages. With Facebook Conversion Pixels, we and Google can identify that someone clicked on our Facebook ad and was thusly redirected to our webpage. However, we cannot see other accessed webpages. The data collected by Facebook Conversion Pixel exclusively serve to preparing statistics on the success and use of our Facebook advertising campaigns. We do not collect and we do not receive any information based on which the user can be identified. Through Facebook Remarketing technology, the users who visited our webpages can be approached again through Facebook targeted advertising. However, we do not collect and we do not receive any information about the Facebook users to whom targeted advertising is addressed. We do not have the possibility to identify individual users in any case. Limitation of Liability
The User expressly states that they understand and agree to the following statements:
I. The use of the service is made on own liability. The service is provided based on “as is” or “as is available” principle. Carmistin Group cannot be held liable for any losses of the User, direct or indirect, resulting from or related to any use or performance level of the service, this website or related websites.
II. Carmistin Group does not provide any guarantee that:
1. the service fulfils all your requirements;
2. the service is provided continuously, in time, safe and without errors;
3. any software errors is corrected;
4. the service is compatible with the user’s software platform of applications;
5. the service or the server making it available to users is free of viruses or other components that may damage the users and cannot be held liable for any actions you take based on such information or the service.
III. Any materials obtained by using the service made available by Carmistin Group is available and can be used only on the User’s own risks. The User is the only one liable for possible damages caused to the computer accessing the service or other data losses that may result from downloading any materials.
IV. No advice or other verbal or written information, obtained by the User, from Carmistin Group through the service implies a guarantee, other than the one expressly provided in the Terms of Use.
V. The company denies all liability in terms of unauthorized takeover of information, images and any other data from the Website or taken over by unauthorized access of the Website.
Carmistin Group Policy on Information Protection
According to the Policy on Information Protection, we can provide other parties (called third parties) certain overall information contained in the registration form or other data of the same nature. We guarantee that such information shall not include personal identification information, except for the cases when this is explicitly accepted by you or in case this is required to observe the law, judicial procedures, in order to apply these terms of use.
Security
The User is aware that Carmistin Group cannot control and does not provide other guarantees on the security of the information crossing its communications network or the Internet or through the Service, except for those required by the Romanian laws in force. The User is aware that the services are available through the Internet and, although Carmistin Group takes all possible measures to maintain information security, it cannot guarantee that the information received or sent by the User using the service is permanently safe.
Connection to Other Networks
The service can be used by the User to discover various information displayed by Carmistin Group on the Internet, in order to connect to other Networks or websites in the world, and the User undertakes to observe the valid use policies in these networks or websites. The User accepts the state of fact that Carmistin Group does not control these websites, is not liable and denies all obligations in terms of other websites, links from other websites and their contents.
Any links to other websites or networks is only for helping the User in the sense of use and does not imply the support or encouragement by Carmistin Group of the materials available on or through such websites or networks or any association with their operators. The User accesses such websites and uses their products and services exclusively on their own risks. Carmistin Group does not guarantee that the services or materials provided by third sources or associated companies are acceptable and available to all areas in Romania. If the User accesses other contents or services on websites of third parties or associated companies, Carmistin Group is not liable for the User or third parties or associated companies observing local laws or other regulatory acts in force in such countries.
Intellectual Property
The User expressly states that they are aware that all stylized representations, logos and associated symbols and their combinations with any word or graphic symbol, used on this website, are trademarks of carmistin.ro team or associated companies.
This website and its contents, as well as all information on this website is the property of CARMISTIN INTERNATIONAL SRL, who reserves the right to change the contents and/or structure of the website at any time and without previous notification.
The Users have the following rights:
- to explore the contents;
- to reproduce, translate or use the published information only with the written agreement of Carmistin Group and specifying the source;
- to insert on own webpages links to this website (when the links are included in commercial or advertising websites, the opening of a new window to view www.carmistin.ro portal must be provided).
You are aware that and you agree that all contents in the advertising banners or promotions or other information available through Carmistin Group is protected by copyright, trademarks or service trademarks, patents or other property rights or applicable laws in force in Romania. You agree not to change, lease, cede, borrow, sell, disseminate or create derived materials, based on the services or software used on the portal, unless this is expressly stipulated by Carmistin Group and referring to the services provided by Carmistin Group.
Copyright on all contents fully belong to Carmistin Group. All contents of carmistin.ro website – images, texts, graphics, symbols, web graphic elements, scripts, software and other data – is the property of Carmistin Group and protected by the Copyright Law and other laws on intellectual and industrial property. The use of any of the elements listed above without the agreement of Carmistin Group is punishable according to the laws in force.
Carmistin Group observes intellectual property rights of other persons and we ask the users of our services to do the same.
Personal Data
According to (EU) Regulation 679/2016, known as the General Data Protection Regulation, on personal data processing and the protection of private life in the sector of electronic communications, Carmistin Group is bound to process personal data provided by you only observing the security measures and for the communicated purpose.
Personal data you send to us on filling in the contact forms or by email is dealt with in strict confidentiality. You are not obligated to send us personal data; however, the data sent voluntarily by you are used exclusively for purpose of processing your request. The date can be subject to intragroup transfer, exclusively for internal purposes. In exceptional cases, the data is processed with our agreement by collaborating partners (attorneys). In such cases, we make sure that our partner, carefully chosen, meets the legal requirements on data protection.
According to (EU) Regulation 679/2016, known as the General Data Protection Regulation, you have the right to access, intervene on your data and the right to not be subjected to individual decisions. At the same time, you have the right to oppose the processing of your personal data and to request their deletion. Also, you are entitled to address the justice system.

- to be informed and to have access to personal data
You have the right to obtain from us a confirmation that your personal data is processed or not and, if so, you have the right to access that data.
- to restrict the personal data processing
There can be cases when you want to restrict the processing of certain data to a certain period of time. For example, you no longer wish to receive commercial messages in certain categories of interest from us for one month. You can, at any time, send us a request by email in this respect. When you wish to cancel the restriction of processing, you can do so through one of the methods used for restriction.
- to oppose the personal data processing
You may at some point wish to not have certain personal data processed by us, but without deleting them from our database. You can exercise this right at any time.
- to download the personal data in an accessible format
You can request your personal data in structured format, currently used and machine-readable. You can submit such request by email.
If, for various reasons, you wish to delete your personal data from our database, you can submit a request in this respect by email.
Warning, in case your personal data is processed in order to observe a legal obligation, the request to delete such data may be denied, in which case only the data we can no longer process without your agreement are deleted.
In order to exercise any of the above rights, you can send a request by email to dpo@carmistin.ro or you can apply them from your user account. In order to make sure you are the owner of the data, please send the requests using the email for which you submit the request.
Newsletter Request
The contents of our newsletter may include information on goods, campaigns and contests of Carmistin Group, as well as information on offers. To subscribe from our free newsletter, you must provide the following information: your email address and optionally your surname/first name for customization of communications with you.
In the subscription process, we also store the webpage from which you initiated the newsletter request process (e.g. the contact form, a contest form or directly from the newsletter subscription page). This serves exclusively to optimize our internet page.
If during the login, you voluntarily provide additional data related to you (surname, first name), we use such data only to insert a personal appellative in the newsletter. You can change or delete such data individually, at any time. The link for this is found in the footer of the newsletter. Subsequently, additional data voluntarily provided is changed according to your requests or is immediately deleted.
After filling in and sending the registration form, you receive from us an email with a confirmation link. If you click the link within 14 days, you become a subscriber. By confirming the subscription, you confirm that you agree to the processing of your email address, subscription page and optional data for the purposes specified here.
You can revoke your consent for requesting our newsletter at any time for the future by clicking the corresponding unsubscribe link in a newsletter or by sending an email to dpo@carmistin.ro. Your email address is immediately deleted from the subscriber database.
What data do we process when you submit an order?
The moment you submit an order on our website, the data we need to process the order are the surname and first name, email address, phone number and mailing address, in case the purchased product requires delivery.
After submitting the order, our colleagues in the “Online Orders Confirmation” will call you to confirm the order, then the proforma or fiscal invoice is issued. In case an invoice is issued, your personal data is archived and stored according to the accounting laws applicable on Romanian territory, for 10 years. Finally, in order to ship the order, your personal data is sent to one of the courier companies with which we have concluded contracts that observe the terms of Regulation 679/2016.
Such companies may be: Fan Curier, Cargus, GLS, Romanian Postal Services or, if required, other company.
Depending on the product you purchase from our online store, you may be contacted by one of our colleagues in the “Quality” Department for improving our services.
Contests with Prizes
You can participate on our internet page to contests with prizes. The personal data sent for participation to contests with prizes is exclusively used for the contest (validation of winners, granting and sending the prize, announcing the winners). After the contest ends and the winners are notified, the participants data is deleted from the database. As a result of certain contests, you can choose for your data to enter the database of Carmistin Group, in order to keep you updated about our activities and promotions.
Please read the contest forms carefully, as well as the Regulations of the contests you enter, available on our internet page or in shops.
Authentication through Social Media (Social Login)
In certain internet pages, we provide the possibility to register and log in through your Facebook, Google+ or Twitter account (Social Login). Your user account in the social media (Google+, Facebook or Twitter) is connected to your user account, so that you can authenticate with the social media user account for the user account and you can log in from there. The advantage is that you do not need to remember another password for the user account. In order to log in, you are redirected to your social media page (Twitter, Facebook or Google+), where you can log in with your user data. Thusly, your Facebook, Twitter or Google+ profile is connected to the user account. As a result of the connection, Facebook Inc., Twitter Inc. or Google Inc. automatically send us the following information:
· Numerical ID for the social media;
· Surname and first name;
· Sex;
· Username on Twitter, Google+ or Facebook;
· The account was verified, e.g. “Yes”;
· Link to your public profile on the selected social media service.
In addition, the social media service operator receives information about the connection of that account to our webpage. We store and use such sent data to identify you as authorized user and to approach you in the correct manner.
General
Amendments of terms – Carmistin Group may amend these terms at any time without notifying the User. Such amendments shall be notified to the User by displaying them on the website under section “Terms and Conditions”. The amendments thusly made are deemed accepted by the User if they continue to use the service after they are displayed on the website.
Major Force – Carmistin Group does not undertake liability for the impossibility to comply with the obligations provided under these terms, as a result of any event outside its control, including, but not limited to fortuitous events, unfavourable weather conditions, government actions or inactions, actions or inactions of other networks or other competent authorities of which Carmistin Group is not responsible.
Jurisdiction – This website (including the websites of third parties to which there are links) is controlled by Carmistin Group. By accessing this website, the User accepts that this contract and any disputes related to it are governed and construed according to the Romanian laws, and the User consents to be subjected to the exclusive jurisdiction of the courts of law on Romanian territory. This website can be accessed from anywhere in Romania and abroad. Carmistin Group does not provide any assurance that the contents of this website comply with the laws (including intellectual property laws) of other countries outside Romania. If the User accesses this website from outside Romania, they do this on their own risks and they are solely liable for observing the laws of the territory where they are located.
Confidentiality – Carmistin Group does not guarantee that the User’s access to the services is confidential. Carmistin Group is not liable for any prejudices caused to the User or any other persons as a result of privacy in terms of the User using this website. Any information the User discloses on the website may not be safe during its transfer through the Internet. Third parties have the possibility of intercepting the transmissions the User makes when using this website. Some services the User accesses on this website allow Carmistin Group to receive personal information.

Cookies Policy
In order to ease the user’s browsing on our internet pages, we use cookies modules (small size files, which a server sends to your computer), with which we manage the connection to our webpages.
Upon ending the internet session, the session cookies modules are automatically deleted.
Carmistin Group collects and stores data for an anonymized profile of the users of these webpages. In this respect, Carmistin Group stores a permanent cookies module in the browser, which allows the recognition of the internet browser. The collected data is used to personally identify the visitor of these internet pages and is not corroborated with personal data referring to the anonymized profile. This method of collecting and storing data with a permanent cookies module can ne deactivated at any time with future effects. You can set your browser so that it notifies you about cookies modules. Thusly, the use of cookies modules becomes transparent for you. However, we must warn you that the functionality of certain pages may be affected in the case of general unacceptance of cookies modules.
Our internet pages also use an internal and anonymous analysis tool for the efficiency of published ads. In the next subpoint, “Advertising”, you can find details about the relevance of such tools from legislative standpoint on data protection. If you reach our webpage by clicking an ad (banner) published by us on a different webpage, a cookie module is stored in your internet browsing software. Based on the cookie module, we can determine if you reached our webpage by clicking this banner. Cookies modules expiry after 30 days. Your identification by us or the tool provider is not possible. If you do not wish to participate to this anonymous analysis, you can deactivate cookies modules in your browser settings.
The steps described below apply to the following versions of internet browsing software: Internet Explorer 11.18.*, Mozilla Firefox 59.0.* and Google Chrome 66.0.*
In case you do not find the buttons specified by us or if you are using a different internet browsing software, please read the instructions on preventing and deleting cookies in the browser assistance menu or application manufacturer menu.
By deactivating the cookies option, you can also affect the functionality of other webpages, therefore return at any time to your internet browsing software settings and change the options depending on the need.

1. Choose the button “Options” from the menu “Customize and control Google Chrome” (upper right side), then choose the button “Advanced”.
2. In the section “Privacy and Security”, choose the button “Content Settings”.
3. Click the button “Cookies”, then uncheck “Allow internet pages to save and read cookies”.
Cookie modules are also used by us to recognize your computer on other webpages participating to Google Display network based on logged data (visiting our webpage, including date and time, language preferences, browser type and operating system) and to display ads adapted to your presumed interests. The categories according to which ads are displayed adapted to your interests in the entire Google Display network can be viewed, eliminated or added by Managing ads preferences. With this tool, you can also reject the general use of cookies modules for customized advertising in Google Display network by downloading and installing the browser insert to deactivate cookie module for ads preferences, by clicking this link. You can personally manage the storing of cookies modules in the browser security settings by unaccepting cookies modules from the start or by accepting them only by subsequent request or setting the cookies modules to be deleted after ending the browser session.
